The goal of the adoption is to achieve <em>zero pellet losses<\/em> and cut one of the main sources of microplastic pollution. They are found in soil, rivers, seas and even remote regions. Once plastic pellets reach the marine environment, they are almost impossible to remove and can remain for decades.<\/p>\n<p style=\"text-align: justify;\">Pellets are often mistaken for fish eggs by seabirds and they make up roughly <strong>70 % of the plastic eaten<\/strong> by seabirds, despite representing only a tiny share of plastic fragments floating at the surface. Large losses at sea have already happened, including spills during vessel incidents, which have washed millions of pellets onto coastlines.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"Who_Must_Comply\"><\/span><strong>Who Must Comply<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">The regulation applies to a wide group of actors:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Economic operators<\/strong> handling at least 5 tonnes of pellets per year in the EU.<\/li>\n<li>Operators running facilities that <strong>clean pellet containers and tanks<\/strong>.<\/li>\n<li><strong>EU and non-EU carriers<\/strong> transporting pellets by road, rail or inland waterways within the EU.<\/li>\n<li><strong>Shippers, operators, agents and masters of seagoing vessels<\/strong> transporting pellets in containers leaving or calling at EU ports.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">The scope is intentionally broad to cover handling, storage, cleaning, inland transport and maritime transport.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"Core_Obligations\"><\/span><strong>Core Obligations<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<h4 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"Risk-management_plans\"><\/span><strong><em>Risk-management plans<\/em><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\">Every installation must develop a detailed <strong>risk-management plan<\/strong> covering site layout, spill-risk points, vulnerable areas, high-risk handling steps, annual estimates of spills, and the equipment and procedures used to prevent, contain and clean up losses. A staff role responsible for recording and reporting spills must also be defined.<\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"Prevention_Containment_and_Cleanup\"><\/span><strong><em>Prevention, Containment and Cleanup<\/em><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\">Operators must follow a priority order:<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>Prevent<\/strong> spills by avoiding unnecessary handling and using good-quality packaging.<\/li>\n<li><strong>Contain<\/strong> any spills so pellets do not escape to the environment.<\/li>\n<li><strong>Clean up<\/strong> spilled pellets in a way that avoids further environmental harm.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: left;\"><strong><em><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-large wp-image-10477\" src=\"https:\/\/www.packlab.gr\/wp-content\/uploads\/2025\/12\/EU-plastic-pellet-regulation-1024x683.jpg\" alt=\"EU plastic pellet regulation - blue synthetic material for plastic industry\" width=\"1024\" height=\"683\" srcset=\"https:\/\/www.packlab.gr\/wp-content\/uploads\/2025\/12\/EU-plastic-pellet-regulation-1024x683.jpg 1024w, https:\/\/www.packlab.gr\/wp-content\/uploads\/2025\/12\/EU-plastic-pellet-regulation-300x200.jpg 300w, https:\/\/www.packlab.gr\/wp-content\/uploads\/2025\/12\/EU-plastic-pellet-regulation-768x512.jpg 768w, https:\/\/www.packlab.gr\/wp-content\/uploads\/2025\/12\/EU-plastic-pellet-regulation-1536x1024.jpg 1536w, https:\/\/www.packlab.gr\/wp-content\/uploads\/2025\/12\/EU-plastic-pellet-regulation-2048x1365.jpg 2048w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/em><\/strong><\/h4>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"Certification_for_Large_Handlers\"><\/span><strong><em>Certification for Large Handlers<\/em><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\">Enterprises handling <strong>1,500 tonnes or more per year<\/strong> must obtain a certificate confirming compliance with Annex I.<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Large enterprises<\/strong> must be certified by 17 December 2027 and then every 3 years.<\/li>\n<li><strong>Medium-sized enterprises<\/strong>: by 17 December 2028, every 4 years.<\/li>\n<li><strong>Small enterprises<\/strong>: by 17 December 2030, then every 5 years.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Certificates must follow the official format in Annex IV and include spot checks.<\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"Transport_Rules_for_Carriers\"><\/span><strong><em>Transport Rules for Carriers<\/em><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\">Carriers must <strong>prevent leakage<\/strong> during loading, unloading and transport by checking packaging integrity, closing ramps, cleaning compartments and using suitable equipment. They must also keep<strong> tools and containers <\/strong>on board for containment and cleanup.<\/p>\n<p style=\"text-align: justify;\">For maritime transport, the regulation adds specific duties including <strong>good-quality packaging<\/strong>, <strong>proper stowage<\/strong> and <strong>timely information<\/strong> from shippers to vessel operators. Containers with pellets should be stowed under deck when possible or in protected positions on deck.<\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"Incident_Reporting\"><\/span><strong><em>Incident Reporting<\/em><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\">If a loss occurs that affects <strong>human health<\/strong> or <strong>the environment<\/strong>, operators must:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Inform<\/strong> emergency services immediately.<\/li>\n<li><strong>Take<\/strong> all possible measures to limit impact.<\/li>\n<li><strong>Report<\/strong> estimated quantities lost, causes and actions taken within 30 days.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"Penalties\"><\/span><strong><em>Penalties<\/em><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\">Member States must impose penalties that are effective and dissuasive. For the most serious infringements by legal persons, administrative penalties must reach <strong>at least 3% of annual EU turnover<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"Timeline_for_Application\"><\/span><strong>Timeline for Application<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul style=\"text-align: justify;\">\n<li>Most rules apply from <strong>17 December 2027<\/strong>.<\/li>\n<li>Some articles apply much earlier, from <strong>16 December 2025<\/strong>, including the designation of competent authorities by the Member States to follow up on the regulation\u2019s topics<\/li>\n<li>Maritime-transport-specific provisions apply from <strong>17 December 2028<\/strong>.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"What_This_Means_for_the_Packaging_Industry\"><\/span><strong>What This Means for the Packaging Industry<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">Packaging producers often handle large volumes of pellets and rely on pellet transport throughout their supply chains. The regulation requires them to:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Map<\/strong> spill-risk points in their facilities.<\/li>\n<li><strong>Adopt<\/strong> structured procedures for prevention and cleanup.<\/li>\n<li><strong>Train<\/strong> staff and document compliance.<\/li>\n<li><strong>Cooperate<\/strong> with transport partners to ensure container integrity and correct stowage.<\/li>\n<li><strong>Prepare<\/strong> for certification if handling above the 1,500-tonne threshold.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Because the law is directly applicable in all Member States, companies cannot wait for national transposition. They must align their internal processes with the regulation itself.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">Regulation (EU) 2025\/2365 sets a high and clear standard for the handling of plastic pellets in Europe. It requires strong prevention measures, transparent reporting, and enforceable penalties. For the packaging industry, this means early planning, upgraded handling systems and closer coordination with transport partners. The regulation does not only seek to reduce pellet losses but aims to eliminate them.
