While current regulations address adulteration broadly, the FDA notes that migration of chemicals from packaging into food has <strong>not previously been regulated<\/strong> through a unified compliance framework.<\/p>\n<p style=\"text-align: justify;\">Scientific literature over several decades has documented the migration of substances from packaging into food under certain conditions. The draft seeks to close regulatory gaps by establishing clearer obligations for food business operators (FBOs) and their packaging suppliers.<\/p>\n<p style=\"text-align: justify;\">Enforcement will be anchored in the <strong>Food Safety Act<\/strong>, the <strong>FDA Act<\/strong>, and the <strong>Consumer Act<\/strong>, providing authorities with administrative tools to address misbranding, adulteration, and non-compliance.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Scope_of_Materials_Covered_by_the_Regulation\"><\/span><strong>Scope of Materials Covered by the Regulation<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">The proposed guidelines apply to both locally manufactured and imported FCAs in finished form that are <strong>intended for direct food contact<\/strong>. Where PNS are not available, ASEAN or other internationally recognized standards may be used as reference points.<\/p>\n<p style=\"text-align: justify;\">Verification may involve documentation review, inspection, and post-market surveillance. The FDA also retains discretion to apply additional appropriate means to confirm safety and suitability.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\" data-start=\"1260\" data-end=\"1309\"><span class=\"ez-toc-section\" id=\"Compliance_Duties_for_Food_Business_Operators\"><\/span><strong data-start=\"1260\" data-end=\"1309\">Compliance Duties for Food Business Operators<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">The draft places primary responsibility on FBOs placing prepackaged processed food products on the market.<\/p>\n<p style=\"text-align: justify;\"><strong>Key<\/strong> <strong>obligations<\/strong> <strong>include<\/strong><strong>:<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Selecting FCAs<\/strong> <strong>suitable for the specific food type<\/strong>, contact duration, and storage or processing conditions<\/li>\n<li>Procuring packaging with <strong>clearly declared intended use, material identity and usage limitations<\/strong><\/li>\n<li>Securing a <strong>Certificate of Suitability<\/strong> or equivalent documentation from FCA suppliers<\/li>\n<li>Maintaining <strong>traceability systems<\/strong> to support control measures and product recalls<\/li>\n<li>Ensuring <strong>proper storage<\/strong> and <strong>handling<\/strong> <strong>of packaging<\/strong> prior to use<\/li>\n<li>Providing <strong>clear warnings<\/strong> for non-edible active or intelligent packaging components, such as sachets labeled \u201cDO NOT EAT\u201d<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\" data-start=\"1311\" data-end=\"1354\"><span class=\"ez-toc-section\" id=\"Implementation_Timeline_and_Enforcement\"><\/span><strong>Implementation Timeline and Enforcement<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">Products already on the market before the order takes effect will have <strong>12 months <\/strong>to comply. During this period, existing stocks may continue to be used, provided they do not pose a food safety risk and do not violate applicable laws.<\/p>\n<p style=\"text-align: justify;\">Following the transition, enforcement actions may include <strong>administrative penalties<\/strong> and <strong>sanctions<\/strong> under the Food Safety Act, the FDA Act, and the Consumer Act.<\/p>\n<p style=\"text-align: justify;\">The order will take effect after publication in the Official Gazette or a newspaper of general circulation and filing with the University of the Philippines Law Center\u2019s Office of the National Administrative Register.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">The Philippines\u2019 draft guidelines is a step toward formalizing controls on food-contact articles used in prepackaged processed foods.
