The two-year transitional period that allowed continued use of previously listed non-evaluated substances has expired and the rules governing packaging inks in Switzerland now apply without exception. The result is a significantly tighter and more coherent framework for packaging inks used on food contact materials, one that aligns Switzerland more closely with the EU&#8217;s own approach under <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32011R0010\" target=\"_blank\" rel=\"noopener nofollow\">Regulation (EU) 10\/2011<\/a> while maintaining its own national positive list structure.<\/p>\n<p style=\"text-align: justify;\">The update also expands the positive list in Annex 10 itself, adding substances that have since been evaluated and authorized. For businesses that rely on substances added in recent cycles, the updated list should be consulted directly via the <a href=\"https:\/\/www.blv.admin.ch\/blv\/en\/home\/gebrauchsgegenstaende\/materialien-in-kontakt-mit-lebensmitteln\/verpackungen.html\" target=\"_blank\" rel=\"noopener nofollow\">Swiss Federal Food Safety and Veterinary Office (BLV)<\/a> to confirm current authorization status.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"The_End_of_Part_B_No_More_Non-Evaluated_Substances\"><\/span><strong>The End of Part B: No More Non-Evaluated Substances<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">The most significant change and the one with the widest compliance implications, is the permanent removal of Part B from Annex 10. Part B had listed substances used in packaging inks that had not yet been fully evaluated for safety. Their inclusion on a separate list allowed continued use under specific conditions (SML: 0.01 mg\/kg) while evaluation processes were ongoing. That framework no longer exists.<\/p>\n<p style=\"text-align: justify;\">From February 2026 onwards, only substances listed in Part A of Annex 10 (the fully evaluated positive list) may be used in the manufacture of packaging inks. Substances that appeared exclusively in Part B and have not since been added to Part A are no longer authorized for use. The updated Annex 10 applies restrictions on these substance groups that mirror the approach taken under 10\/2011, representing a tightening of the previous Swiss position and a deliberate move toward harmonization with EU food contact plastics legislation.<\/p>\n<p style=\"text-align: justify;\">The second concerns substances not included on the positive list. In line with the approach already established under 10\/2011, substances absent from the Annex 10 positive list may still be used in packaging inks, provided they are not classified as carcinogenic, mutagenic or toxic to reproduction (CMR substances in categories 1A, 1B or 2 under Swiss chemicals legislation) and that their migration into food or food simulants is not measurable above a detection limit of 0.01 mg\/kg. This is not an authorization of unlisted substances but a defined tolerance framework for those that cannot be detected at meaningful levels. The burden of demonstrating compliance with both conditions falls on the ink producer.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Declaration_of_Compliance_Now_Required_from_Ink_Producers\"><\/span><strong>Declaration of Compliance Now Required from Ink Producers<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">A significant procedural change introduced by the updated Ordinance is the mandatory requirement for ink producers to issue a Declaration of Compliance (DoC). Previously, the DoC obligation was well established for food contact materials at the packaging level, but the requirement to document compliance at the ink production stage itself was less clearly defined in Swiss law.<\/p>\n<p style=\"text-align: justify;\">Under the current framework, a DoC must now accompany inks for food packaging at every stage of the supply chain up to and including the final packaged food product, though not at the retail stage. The DoC must cover all intentionally added substances (IAS) as well as non-intentionally added substances (NIAS) that may migrate into food. This brings Switzerland into alignment with the documentation expectations that are already standard practice under EU legislation and, in Germany, under the Printing Inks Regulation.<\/p>\n<p style=\"text-align: justify;\">For packaging producers and food producers receiving printed packaging, this means that their supply chain documentation should now include a DoC issued by the ink producer, along with a DoC issued by the packaging converter. Auditors and enforcement authorities are entitled to request this documentation and the absence of it is considered a compliance gap.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">The full entry into force of Annex 10 Edition 3.2 closes a transitional period that had allowed parts of the Swiss packaging inks market to operate under legacy conditions. The framework that now applies is stricter, better aligned with EU standards and more demanding in terms of documentation.<\/p>\n<p style=\"text-align: justify;\">For businesses active in the Swiss market, whether as ink producers, packaging converters or food producers, the practical priorities are clear: confirm that all substances in use are either listed on the current Part A positive list or demonstrably compliant with the 0.01 mg\/kg non-CMR framework and ensure that a complete DoC chain exists from ink production through to packaged product.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Annex 10 Edition 3.2 of the Swiss Ordinance on food contact materials is fully in force.
