Following the footsteps of Spain and UK, Germany introduced its plastic tax through the \u201cSingle-Use Plastic Fund Act\u201d of May 11, 2023, (<strong><a href=\"https:\/\/www.recht.bund.de\/eli\/bund\/bgbl-1\/2023\/124\" rel=\"nofollow noopener\" target=\"_blank\">EWKFondsG<\/a><\/strong> in German) for short. This comprehensive plan strives to achieve climate neutrality and sustainability by 2050, emphasizing measures to reduce greenhouse gas emissions and promote the circular economy. <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:32019L0904\" target=\"_blank\" rel=\"nofollow noopener\">Directive 2019\/904<\/a>, issued on June 5, 2019, by the EU, serves as a guide for member states to implement strategies that reduce the environmental impact of plastic products.<\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong><\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Levys_Estimated_Revenue\"><\/span><strong>Levy\u2019s Estimated Revenue<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">The single-use plastic levy will lead to estimated revenues of up to \u20ac 436 million for the German federal government, state governments and municipalities, which will be transferred in full to the eligible public-law waste management authorities and other entitled legal entities, in accordance with the legal requirements of the EWKFondsG.<\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong><\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"The_Levy_Rates\"><\/span><strong>The Levy Rates <\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">The levy rates were adopted by the German Bundestag and made public in the Federal Law Gazette (Federal Law Gazette I 2023, No. 274) in the form of the Ordinance to the EWKFondsG of 11 October 2023, <a href=\"https:\/\/technical-regulation-information-system.ec.europa.eu\/hu\/notification\/23749\/text\/D\/EN\" target=\"_blank\" rel=\"nofollow noopener\">EWKFondsV<\/a>.<\/p>\n<p style=\"text-align: justify;\">The following levy rates in <strong>euros per kilogram<\/strong> apply to the single-use plastic levy under Section 12 of the Single-Use Plastic Fund Act:<\/p>\n<ul>\n<li>food containers- \u20ac 0.177<\/li>\n<li>bags and foil packaging &#8211; \u20ac 0.876<\/li>\n<li>non-deposited beverage containers &#8211; \u20ac 0.181<\/li>\n<li>beverage containers with deposit &#8211; \u20ac 0,001<\/li>\n<li>beverage cups &#8211; \u20ac 1.236<\/li>\n<li>lightweight plastic carrier bags &#8211; \u20ac 3.801<\/li>\n<li>wet wipes &#8211; \u20ac 0.061<\/li>\n<li>balloons &#8211; \u20ac 4.340<\/li>\n<li>tobacco products with filters and filters for tobacco products &#8211; \u20ac 8,972<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-large wp-image-4416\" src=\"https:\/\/www.packlab.gr\/wp-content\/uploads\/2024\/03\/pexels-pavel-danilyuk-7055321-1024x684.jpg\" alt=\"plastic tax empty bottles\" width=\"1024\" height=\"684\" srcset=\"https:\/\/www.packlab.gr\/wp-content\/uploads\/2024\/03\/pexels-pavel-danilyuk-7055321-1024x684.jpg 1024w, https:\/\/www.packlab.gr\/wp-content\/uploads\/2024\/03\/pexels-pavel-danilyuk-7055321-300x200.jpg 300w, https:\/\/www.packlab.gr\/wp-content\/uploads\/2024\/03\/pexels-pavel-danilyuk-7055321-768x513.jpg 768w, https:\/\/www.packlab.gr\/wp-content\/uploads\/2024\/03\/pexels-pavel-danilyuk-7055321-1536x1025.jpg 1536w, https:\/\/www.packlab.gr\/wp-content\/uploads\/2024\/03\/pexels-pavel-danilyuk-7055321-2048x1367.jpg 2048w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: left;\"><span class=\"ez-toc-section\" id=\"EWKFondsGs_Objective_and_Details_on_%E2%80%9CSingle-use%E2%80%9D_Products_and_Manufacturers\"><\/span><strong>EWKFondsG\u2019s Objective and Details on \u201cSingle-use\u201d Products and Manufacturers<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">The primary objective of EWKFondsG is to prevent the harmful effects of certain single-use plastic products on the environment and human health, while encouraging innovative and sustainable alternatives.<\/p>\n<p style=\"text-align: justify;\">EWKFondsG covers the first-time provision of certain EWK products on the German market. These are products that consist entirely or partially of plastic, i.e. artificially produced polymers (in accordance with Art. 3 No. 5 of the <a href=\"https:\/\/environment.ec.europa.eu\/topics\/chemicals\/reach-regulation_en\" target=\"_blank\" rel=\"nofollow noopener\">REACH Regulation<\/a>) and include:<\/p>\n<ul>\n<li>Containers for foodstuffs whose contents are intended for immediate consumption<\/li>\n<li>Bags and film packaging made from flexible material, such as wrappers<\/li>\n<li>Beverage containers with a filling volume of up to 3 liters<\/li>\n<li>Beverage cups including their closures and lids<\/li>\n<li>Wet wipes intended for household and personal care<\/li>\n<li>Balloons intended for consumers<\/li>\n<li>Tobacco products with filters and the filters themselves<\/li>\n<li>Lightweight plastic carrier bags<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Levy\u2019s earnings will be directed towards funding future waste management costs incurred in connection with the disposal and reduction of certain SUP products. The responsibility for compliance falls on manufacturers, importers, and sellers operating within Germany, who must register with the Federal Environment Agency and fulfill their <a href=\"https:\/\/www.bdo.de\/en-gb\/insights\/publishments\/tax-legal\/plastics-tax-in-germany-the-single-use-plastic-fund-act\" target=\"_blank\" rel=\"nofollow noopener\">reporting obligations<\/a>.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Requirements_for_Market_Participants\"><\/span><strong>Requirements for Market Participants<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">To navigate the complexities of EWKFondsG, market participants (legal entities and partnerships with legal capacity) must assess their involvement and obligations under the law. This includes determining whether their products fall within the scope of the legislation, initiating the required registration procedures and addressing categorization issues. Additionally, internal processes and systems should be reviewed and adapted to ensure compliance with reporting and payment requirements.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">Germany&#8217;s implementation of the plastic tax underscores the nation\u2019s commitment to sustainability.
