By adopting the Benelux decision, the Netherlands, Belgium and Luxembourg ensure uniform standards across their internal market, thus facilitating trade and maintaining high consumer protection. Prior to this amendment, the Netherlands already enforced national measures; the current changes adjust those where necessary to reflect the Benelux rules.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Key_Amendments\"><\/span><strong>Key Amendments<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<h4><span class=\"ez-toc-section\" id=\"Expanded_Definitions\"><\/span><strong> Expanded Definitions<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\"><strong>Chapter IV, Section 1 <\/strong>now clarifies that:<\/p>\n<ul style=\"text-align: justify;\">\n<li>An <strong>\u201calloy\u201d<\/strong> is a macroscopically homogeneous metal made of two or more elements inseparable by mechanical means.<\/li>\n<li><strong>\u201cMetals<\/strong>\u201d are defined by their solid-state properties: metallic luster, electrical and thermal conductivity, and mechanical strength and malleability.<\/li>\n<li>The scope covers all packaging and utensils wholly or partly composed of metals or alloys, whether coated or uncoated.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong><\/p>\n<h4><span class=\"ez-toc-section\" id=\"Updated_Specific_Migration_Limits\"><\/span><strong> Updated Specific Migration Limits <\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\">In <strong>Section 4.3<\/strong> of the regulation, numerous <strong>Specific Migration Limits<em> (<\/em>SMLs)<\/strong> (in mg\/kg of food) have been revised:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Arsenic<\/strong> reduced from 0.01 to 0.002<\/li>\n<li><strong>Cadmium<\/strong> from 0.01 to 0.005<\/li>\n<li><strong>Chromium<\/strong> increased from 0.1 to 0.25<\/li>\n<li><strong>Cobalt<\/strong> from 0.05 to 0.02<\/li>\n<li><strong>Copper<\/strong> from 5 to 4<\/li>\n<li><strong>Lithium<\/strong> compounds from 0.6 (as Li) to 0.048<\/li>\n<li><strong>Manganese<\/strong> from 0.6 to 1.8<\/li>\n<li><strong>Vanadium<\/strong> from 0.05 to 0.01<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong><\/p>\n<h4 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"_Addition_of_New_Metals_and_SMLs\"><\/span><strong>\u00a0<\/strong><strong>Addition of New Metals and SMLs<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"text-align: justify;\">The amendment introduces SMLs for eight additional elements:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>Barium<\/strong> (1.2)<\/li>\n<li><strong>Beryllium<\/strong> (0.01)<\/li>\n<li><strong>Iron<\/strong> (40)<\/li>\n<li><strong>Mercury<\/strong> (0.003)<\/li>\n<li><strong>Molybdenum<\/strong> (0.12)<\/li>\n<li><strong>Thallium<\/strong> (0.0001)<\/li>\n<li><strong>Tin<\/strong> (100, unless otherwise specified in Commission Regulation (EU) 2023\/915)<\/li>\n<li><strong>Silver<\/strong> (0.08)<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Tin\u2019s reference to <a href=\"https:\/\/eur-lex.europa.eu\/eli\/reg\/2023\/915\/oj\/eng\" target=\"_blank\" rel=\"noopener nofollow\">Regulation (EU) 2023\/915<\/a> ensures consistency with the latest EU maximum contaminant levels in foodstuffs.<\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Procedural_Updates_and_Compliance_Demonstrations\"><\/span><strong>Procedural Updates and Compliance Demonstrations<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<ul style=\"text-align: justify;\">\n<li><strong>Section 4.5<\/strong> (formerly regarding tin) has been removed, as tin is now covered in the main SML table.<\/li>\n<li>Renumbering adjusts subsequent sections accordingly.<\/li>\n<li>A new <strong>Section 4.9<\/strong> mandates that operators provide a written declaration of conformity in line with Article 16 of Regulation (EC) No 1935\/2004 (general food contact materials regulation) and the annex\u2019s Chapter 0.9.<br \/>\n<h4><\/h4>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong><\/p>\n<p><strong style=\"text-align: justify;\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-8928 size-large\" \/><\/strong><\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Alignment_with_EU_Legislation\"><\/span><strong>Alignment with EU Legislation<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">The regulation was notified to the European Commission under Directive (EU) 2015\/1535 on technical regulations. The Commission\u2019s remarks highlighted overlap with specific migration limits for plastics under Regulation (EU) No 10\/2011. The Dutch response clarifies that, for composite articles, only the metallic portion falls under the amended SMLs, while any plastic components must meet Regulation 10\/2011 standards.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">This amendment modernizes the Dutch regulation on food-contact metals by integrating Benelux and EU standards, refining migration limits for existing and newly listed elements, and reinforcing compliance documentation.
