European commision recently published the latest amendment (EC) 1442/2023 of legislation (EC) 10/2011 regarding plastic materials in contact with food.
This new change to the legislation comes as a continuance of the previous amendment in 2020 and the most important changes included can be seen below:
– Certain phthalates (DINP, DBP, BBP and DEHP), which were already included in the “positive list” have now a lower SML value.
– Furthermore, specific phthalates (DBP, DIBP, BBP, DEHP) are also subject to a sum limit.
– Substances with FCM 96 (wood flour and fibers, untreated) and FCM 121 (salicylic acid) are excluded from the positive list of substances.

Plastic materials which enter the market before 1st February 2025 can remain at the market until stock exhaustion.
However, the intermediate products, which are used to manufacture the aforementioned plastic materials and contain substances subject to limitations according to this amendment, should clearly state in their declaration of compliance (DoC) that they can be used in production until 1st February 2025.
