Packaging is one of the few business functions where aesthetics, regulation, material science, and supply chain logistics intersect in a single decision. Marketing teams are well positioned to evaluate shelf appeal, consumer trends and brand consistency, but these are only a fraction of what determines whether a packaging solution will actually work.

The PPWR, the bisphenol restriction, the PFAS prohibition, the recycled content mandates, the eco-modulation of EPR fees are now the defining constraints of packaging development. The consequences are concrete: failed recyclability assessments and products that cannot legally be placed on the EU market.
What the PPWR Actually Requires from a Design Perspective
The Packaging and Packaging Waste Regulation (EU) 2025/40 has direct implications on how packaging is designed. It imposes binding requirements across several dimensions simultaneously, many of which conflict with standard commercial practices.
Minimization
Minimization is one of the clearest examples. Article 10 of the PPWR prohibits packaging that is not designed to minimize its weight and volume while maintaining the functionality required for the contained product. This directly challenges the instinct to use generous packaging as a proxy for premium positioning. Double walls, false bottoms and oversized formats that increase perceived product value are explicitly inconsistent with this requirement. For e-commerce packaging, the void space ratio must not exceed 50 %, a constraint that eliminates a wide range of standard shipping configurations.
Recyclability
Article 6 requires all packaging placed on the EU market to be recyclable by 2030, according to harmonised design-for-recycling criteria. This is not a material-by-material decision that can be left to the supplier. It requires a holistic assessment of the full pack structure, including closures, labels, adhesives, barrier coatings and print inks. A single incompatible component can make the whole pack fall short of the design-for-recycling criteria.
Substance restrictions
Article 5 adds another layer of complexity. PFAS are prohibited in food-contact packaging from 12 August 2026. The sum of cadmium, lead, mercury and hexavalent chromium must not exceed 100 mg/kg. From September 2026, the EU 10/2011 Quality Amendment requires full knowledge of all substances in plastic food contact materials, including non-intentionally added substances.
The Sustainability Sacrifice Problem
The shift toward recyclable, minimal and reuse-compatible packaging consistently involves sacrificing something that matters commercially.
Barrier performance is the most common casualty. Multi-material laminates deliver excellent oxygen and moisture barrier properties, extend shelf life and reduce food waste. However, they are structurally difficult to recycle. Replacing them with mono-material alternatives that meet recyclability requirements often means accepting shorter shelf life, changed processing conditions or higher material costs. This is a design trade-off that needs to be made consciously, with input from food safety, logistics, procurement and sustainability.
Convenience features present a similar challenge. Resealable closures, easy-open tear strips, portion-separating packaging all add functional value that consumers recognize and that drives purchase decisions. Many of them also add material complexity that conflicts with recyclability, minimization or chemical safety requirements. The question is not whether to sacrifice these features entirely, but where the threshold lies for each application.
The same challenge extends to pack size rationalisation. The PPWR’s minimization requirements, combined with EPR fee structures that charge by weight and material type, create a genuine economic incentive to move toward larger pack sizes and reduced secondary packaging. Marketing teams that have built range architecture around small, individual-serve formats may find those formats increasingly penalized.
EPR Fees Are Now a Design Signal
One of the structural changes introduced by the PPWR is the eco-modulation of producer fees. Packaging that is harder to recycle or that contains prohibited substances is not merely non-compliant. It is in fact more expensive to place on the market, because the disposal fee is higher. Conversely, packaging designed to achieve green recyclability ratings and to use compliant materials costs less to run through the EPR system.
This means that packaging design decisions now have a direct and measurable financial consequence that shows up in profit and loss statements, not just in a compliance report. For finance teams and senior commercial leadership, this is the most legible argument for involving technical and regulatory expertise earlier in the design process: the cost of getting it wrong is no longer hypothetical.
What Earlier Technical Involvement Looks Like in Practice
The shift being advocated here is not about removing marketing’s role in packaging decisions, but about sequencing the inputs in a different way. A technically informed brief includes the regulatory status of each material component in the target markets, the recyclability classification of the proposed pack structure under applicable methodologies, the substance compliance position including PFAS, heavy metals and restricted substances, the EPR fee exposure by material type and recyclability rating and the shelf-life and barrier performance implications of compliant material alternatives.
This requires the same structured collaboration that already happens between marketing and procurement on cost, or between marketing and logistics on pack dimensions, applied to compliance and sustainability before the design direction is locked.
Conclusion
The regulatory environment for packaging in 2026 is not a compliance layer sitting on top of commercial decisions. The PPWR’s minimization requirements challenge premium positioning through generous packaging. Its recyclability obligations expose every material choice in the pack structure to regulatory scrutiny. Its substance restrictions reach into food contact compliance and chemical safety in ways that are invisible to a conventional marketing brief. And its EPR fee modulation translates all of these technical decisions into financial outcomes. Bringing technical and regulatory expertise into packaging decisions at the brief stage is not a shift in organizational power, but a response to a regulatory environment that no longer accommodates a purely commercial approach to packaging design.
